VFR CONDITIONS- Weather conditions equal to or better than the minimum for flight under visual flight rules. The term may be used as an ATC clearance/instruction only when:
a. An IFR aircraft requests a climb/descent in VFR conditions.

 


In VFR conditions, ATC works around that by relying on pilots to see nearby traffic, but when the clouds roll in, they're back to the five-mile rule, and traffic slows to a crawl.

The VFR conditions responsibility to see and avoid rests with you, the pilot. ATC's responsibility, authority and accountability for separation exists only under IFR conditions for IFR vs. IFR flights.

Safe, legal planning requires that enough fuel is on board to reach the destination, plus fuel enough to fly an additional 30 minutes, if flying during VFR conditions.

VFR-on-top. ATC authorization for an IFR aircraft to operate in VFR conditions at any appropriate VFR altitude.
VFR over-the-top. A VFR operation in which an aircraft operates in VFR conditions on top of an undercast.

This is a really useful thing to know and VORs have been a primary way of instrument navigation as well as being very helpful in VFR conditions. They are often colocated with DME, making them even more useful.

If both aircraft were in VFR conditions then it would be the responsibility of the pilot to avoid an incident or accident but the controller would most likely call out 'traffic' and issue a vector to safety.
