1. A judicial proceeding that involves either civil or criminal claims. An action is brought by one or more plaintiffs against one or more defendants.

Actions are voluntary and involuntary. The former are performed freely and without constraint - the latter are performed not by choice, against one's will or in a manner independent of the will.

Action: Judicial proceeding.

Class action
When different persons combine their lawsuits because the facts and the defendant are so similar.

Legis Actiones: Archaic form of Roman trial litigation. Replaced by the Formulae system in the 2nd century BC.

class action: Rule 23; a device whereby a representative may assert the rights of numerous other persons in a lawsuit without the necessity of having each class member participate in the lawsuit.

CLASS ACTION SUIT: A lawsuit in which one or more parties file a complaint on behalf of themselves and all other people who are "similarly situated" (suffering from the same problem).

Civil Action
A lawsuit outside of the criminal justice system, seeking redress or an award of damage for a civil wrong.
