arrest of judgment The act of staying a judgment, or refusing to render judgment in an action at law, after verdict, for some matter appearing on the face of the record, which would render the judgment, if given, erroneous or reversible.

Originally this remedy could be entered only in favor of the plaintiff, and the similar remedy of arrest of judgment could be entered only in favor of the defendant.

When the variance is a matter of substance, as if the writ sounds in contract, and the other in tort, and e converso, or if the writ demands one thing or subject, and the declaration another, advantage may be taken of it, even in arrest of judgment; ...
