ATTAINDER (from the O. Fr. ateindre, ateindre, to attain, i.e. to strike, accuse, condemn; Lat. attingere, tangere, to touch; the meaning has been greatly affected by the confusion with Fr.

 


Attainder by verdict, is when the prisoner at the bar pleads not guilty to the indictment, and is pronounced guilty by the verdict of the jury.
Attainder by process or outlawry, is when the party flies, and is subsequently outlawed.

Bill of Attainder definition:
Conviction and sentence to death directly by statute, as opposed to resulting from trial.
Conviction and sentence to exile or death by statute, as opposed to resulting from trial.

Bill Of Attainder A legislative act that declares a named person guilty of a crime, particularly treason. Such bills are prohibited by Article I, Section 9 of the United States Constitution.
