Capital Case A prosecution for murder in which the prosecutor asks the jury to decide if the defendant is guilty and, if he is, whether he should be put to death.

 


Capital Case: A criminal case in which death sentence may be imposed.

capital case - A prosecution of a crime for which a possible punishment is death.
Capital Crime - A crime punishable by death.
capital gains - The profit on the sale of a capital asset, such as stock or real estate.

capital case: A criminal case where the defendant can get the death penalty.
capital offense: A crime that you can get the death penalty for committing.

The sentence, with certain exceptions in capital cases, is within the sole discretion of the judge, subject to the statutory prescriptions as to the kind and maximum of punishment.

A juror who has conscientious scruples in finding a verdict in a capital case may be challenged.

The Judicial Council committee recommended that, even in non-capital cases, a person's dangerousness should be considered in determining conditions for release.
