Claimant: The claimant in a personal injury case is the person (or persons) injured as a result of the negligence of one or more other parties.

 


CLAIMANT - A person making a claim. Syn. plaintiff.
In the courts of admiralty, when the suit is in rem, the cause is entitled in the name of the libellant against the thing libelled, as A B v.

Claimant - The name, under the Civil Procedure Rules, given to the party making a claim in the Courts. (Previous term = plaintiff).

Claimant
A person making a claim. For example, in hearings involving the Employment Security Department, the party who has made a claim for unemployment benefits is called the claimant.

A claimant must show real grounds for suspecting that the defendant is destroying or will destroy documents or would not comply with an order for disclosure.

A claimant must give an undertaking to the Court to pay any damages which the defendant (or any other party served with or notified of the order) sustains if it turns out that the order should not have been granted.

A claimant who suffered only emotional distress and no pecuniary loss would not recover for negligence. However, courts have recently allowed recovery for a plaintiff to recover for purely emotional distress under certain circumstances.

Plaintiff
The person who brings an case to court; who sues. May also be called "claimant", "petitioner" or "applicant. The person being sued is generally called the "defendant" or the "respondent."

Plaintiff:
A person who initiates a case in Court. That person may also be referred to as the Claimant, Petitioner or Applicant. The person who is being sued is generally called the Defendant or Respondent.

Section 75 of the Sex Discrimination Act. Under this section an individual who is an actual or prospective complainant or claimant may apply to the EOC for assistance.
Serving proceedings
Delivering/sending documents to the other party.

If the claim is disapproved the claimant can initiate legal proceedings.The claim has to bae made after the death of the person is publicly announced to a few months as specified by the law,failing to do so the claim will not be considered.

Appeal: A request for a case to be looked at again by a higher court. Permission is not always granted. Appeals are possible in civil cases from either the defendant or the claimant but in criminal cases only from the accused.

Such disclaimers are required to be in writing and recorded in the USPTO, and are considered as part of the original patent to the extent of the interest actually possessed by the disclaimant and by those claiming under him.

quiet title action - A proceeding to establish the plaintiff's title to land by bringing into court an adverse claimant and there compelling him either to establish his claim or be forever after estopped from asserting it.

Literally meaning "rights of a third [person]", is a defense in tort law against claims of possession such as detinue, or conversion. It is the acknowledgement of a third party who has better possession than the claimant seeking the action.
