These declarations, contrary to the general rule that hearsay is not evidence, are constantly received.

 


DECLARATIONS, evidence. The statements made by the parties to a transaction, in relation to the same.

The motion is supported by declarations under oath, excerpts from depositions which are under oath, admissions of fact by the opposing party and other discovery, as well as a legal argument (points and authorities).

Spontaneous declarations are exceptions to the hearsay rule under the excited utterance exception.

a phrase often used in legal pleadings (complaints and answers in a lawsuit), declarations under penalty of perjury, and affidavits under oath, in which the person making the statement or allegation qualifies it.

Vessel manifest: the international carrier is obligated to make declarations of the ship's crew and contents at both the port of departure and arrival. The vessel manifest lists various details about each shipment by b/l number.

Unconstitutional means the law, act, contract or declarations which are contrary to the provisions set in the constitution. For example the constitution disclaim disparity among human races.

It may be proved by reputation, declarations, conduct and other circumstances usually accompanying the relation - 1 Bl. Com. 439; and by what would be proof where the marriage took place. Patterson v. Gaines, 6 How. 587 (1818).
