DONOR - One who gives or makes a gift or a bequest under a will; creator of a trust; party confering a power.

Donor:
The person who donates property to the benefit of another, usually through the legal mechanism of a trust. Also referred to as a "settlor." Also used to describe the person who signs a power of attorney.

Donor: The giver; one who makes a gift or sets up a trust. In medical jurisprudence, one who gives blood or an organ to a recipient.

For the Donor
One reason that the recipient of a bequest is usually not taxed on the bequest is because the donor may be taxed on it. Donors of bequests may be taxed in through other mechanisms such as federal wealth transfer taxes.

Donatio mortis causa: (Latin: gift due to death) Gift made by a dying person with the intent that the person receiving the gift shall keep it if the donor dies from his existing complaint.

These grants were also known as feuda conditionata, because if the donee had no heirs of his body the estate reverted to the donor.

The one who gives is the donor; the one who receives the gift, the donee. There are two main classes of gifts, gifts inter vivos and gifts causa mortis. The former is an outright transfer of property, the ordinary type of gift.

The person signing the power of attorney is usually referred to, in law, as the donor and the person that would exercise the power of attorney, the donee.

The trust is set up so that the donor (or other beneficiaries named in the trust) receives trust income for a number of years or for life, after which the assets go to a tax-exempt charity.

An advancement is a gift made during a donor's life to a family member, usually when the donor anticipates his own death. The value of the advancement is included in the calculation of the net probate estate when the donor dies.
