The Dred Scott case which upheld the concept of fugitive slaves being mere property having no human rights is now generally considered one of U.S. Supreme Court's worst decisions, and partially responsible for the events leading to the Civil War.
FUGITIVE SLAVE. One who has escaped from the service of his master.
The Fugitive Slave Law of 1850 required individuals to return runaway slaves to their owners. During the war, Union generals such as Benjamin Butler, declared that slaves in occupied areas were contraband of war and accordingly refused to return them.
In Rome sanctuary was often sought by fugitive slaves. Christian churches were given the right of sanctuary by Constantine I. Abuses of sanctuary, tending to encourage crime, led to its curtailment and abolition.
