Gross Negligence
(n) Gross Negligence is the state of doing an activity where in the safety and security of other connected persons and property are knowingly disregarded. Gross negligence is a way of violating others rights.

 


Gross Negligence: Intentional failure to perform a manifest duty in reckless disregard of the consequences to another person's life or property. There is no clear distinction between gross negligence and willful negligence.

Gross Negligence: Failure to use even the slightest amount of care in a way that shows recklessness or willful disregard for the safety of others.

In English law gross negligence is the test for manslaughter. The crime was defined in R v Bateman as 'to show such disregard for life and the safety of others as to amount to a crime against the state and conduct deserving of punishment.
