MARTIAL LAW. " Martial law" is an unfortunate term and in a sense a misnomer. It describes a suspension of ordinary law, rendered necessary by circumstances of war or rebellion.

 


Martial Law definition:
The suspension of regular government and habeas corpus or the reliance of military law enforcement.
Temporary military takeover of law enforcement.

Martial Law is most easily defined as the application of military force to control all or part of an area where civilian authority is ineffective or in defiance of higher authority.

Martial Law
(n) Martial Law is the law prevailing in the land, when it is subjected to military activities or when it is under a military rule arising out of a situation like war, calamities, disasters, emergencies etc.

Martial law. The law of military necessity in the actual presence of war, administered by the general of the army. Martial law is built upon no settled principles, but is entirely arbitrary in its decisions.
