Mistrial
(n) Mistrial is the declaration by a judge terminating or otherwise discontinuing the trial for any reasons by which the trial could not be continued in that court.

Mistrial

MISTRIAL - A mistrial is a court ruling made by a trial judge after a jury is impaneled but before the jury is able to reach a decision of innocence or guilt of the defendant on the pending criminal charge(s).

After a mistrial due to a hung jury, Hiss was tried a second time. In January 1950, he was found guilty on both counts of perjury and received two concurrent five-year sentences, of which he eventually served 44 months.

The result is a mistrial. Majority verdicts of 10-2 are allowed to prevent a hung jury.

When the jurors, after full debate and discussion, are unable to agree on a verdict and are deadlocked with differences of opinion that appear to be irreconcilable, it is said to be a "hung jury". The result is a mistrial.
