NECESSARY AND PROPER. The Constitution of the United States, art. 1, s.

 


He emphasized the "necessary and proper," or elastic, clause of the Constitution, which said that Congress could do whatever it thought essential to fulfill its obligations.

In the case Southern Pacific Co. v. Jensen, 244 U.S. 205 (1917), the Supreme Court determined that the Necessary and Proper Clause grants to Congress complete and plenary power to fix and determine the maritime laws throughout the country.
