out of court
adj. referring to actions, including negotiations between parties and/or their attorneys, without any direct involvement of a judge or the judicial system.

Hearsay is an out of court statement being offered for the truth of the matter asserted. Both elements must exist for the evidence to be classified as hearsay.

Hearsay
An out of court statement which is neither an admission or a declaration against interest. Hearsay evidence is generally not admissible in a judicial proceeding.

Trial: Many cases do not settle out of court. For whatever reason, the opposing sides just don't see eye-to-eye on important issues of liability and/or damages.

Under some circumstances, statements made out of court by one person may be repeated in court by someone else even though the hearsay rule ordinarily forbids secondhand testimony.

A catchall term that describes a number of methods used to resolve disputes out of court, including negotiation, conciliation, mediation and the many types of arbitration.

DEPOSITION - The sworn testimony of a witness taken before trial held out of court with no judge present. The witness is placed under oath to tell the truth and lawyers for each party may ask questions. The questions and answers are recorded.

A privy verdict is one delivered privily to a judge out of court. A verdict of this kind is delivered to the judge after the jury have agreed, for the convenience of the jury, who after having given it, separate.

Definition: A rule of evidence which makes out of court statements used to prove the truth of the matter stated inadmissible.

Writ: A formal order of a court, in writing, ordering someone who is out of court to do something.
Writ of execution: An order of the court that its judgment (decision) be carried out.

DISMISSAL -- An order or judgment deciding a particular lawsuit in favor of the defendant by sending it out of court without trial.

DEPOSITION: Part of the pre-trial discovery (fact-finding) process in which a witness testifies under oath. A deposition is held out of court with no judge present, but the answers often can be used as evidence in the trial.
