Priority of distribution. All creditors are not treated equally. There are several levels of priority in the distribution of assets. A creditor with a security lien on property (e.g., bank mortgage) has priority over other creditors.

n. the right to be first or ahead of the rights or claims of others. In bankruptcy law, the right to collect before other creditors is given to taxing authorities, judgment holders, secured creditors, bankruptcy trustees and attorneys.

Even constitutions fall into this category and, though they are not often changed and wisdom urges us to refrain from changing them except upon the highest priority, yet they, too, can be amended, revised, or done away with altogether.

Laborer's liens establish priority for the payment of employees in favor of general creditors in cases of bankruptcy; mechanic's liens similarly provide priority for the payment of contractors who provided goods and services for building projects.

Strictly speaking, a creditor who has a lien or a charge (such as a mortgage) and thus, a priority on an asset (or fund), and also has access on another asset, can collect off one or the other or both, to the satisfaction of his debt.

Yet, as to personalty, their decrees are equal to a judgment and have preference according to priority. They are also conclusive between the parties.
