Provocation
It is an act of provoking someone to do a certain act which is normally associated to danger, anger, illegal acts or getting out of control.

 


Provocatione: Laws related to provocatio, or the right of a citizen to appeal capital sentences (death or exile).
Publicando: Public property.

Provocation: A killing which occurs after provocation by an event which would cause a reasonable person to lose self-control.
Imperfect self-defense: allowed only in a limited number of jurisdictions in the United States.

The provocation which reduces the killing from murder to manslaughter is an answer to the presumption of malice which the law raises in every case of homicide; it is therefore no answer when express malice is proved. 1 Russ.

Expanded Legal Definition of HarassmentHeat of Passion A sudden uncontrollable state of mind provoked by a blow or some other personal provocation.

TOP Manslaughter : Accidental homicide or homicide which occurs without an intent to kill, and which does not occur during the commission of another crime or under extreme provocation.

HEAT OF PASSION - A mental state provoked by fear, rage, anger or terror that, combined with adequate provocation, is an element of certain crimes like voluntary manslaughter.

Such mitigation does not negate an offence or wrongful action. For example, assault caused by provocation is still assault, but provocation may constitute mitigating circumstances and allow for a lesser sentence.

MURDER
Intentional homicide (the taking of another person's life), without legal justification or provocation.

It is common practice for juries to add to their verdict, guilty or not guilty, a rider recommending the accused to mercy on the ground of grave provocation received, or other circumstances which in their view should mitigate the penalty.

For example, provocation may constitute mitigating circumstances in an assault action.
Mitigation of damages: A person who sues another for damages has a duty to minimize his loss, as far as reasonable.
