Federally registered marks are benefited by: the owner's ability to take action in federal court on behalf of the mark; the owner's ability to legally enforce the mark nationwide; the owner's ability to use the filing date of the U.S.

If a conflict exists between your mark and a registered mark, the examining attorney will refuse registration on the ground of likelihood of confusion.

Unregistered trademark rights may be enforced by way of a lawsuit for passing off, while the exclusive rights which attach to a registered mark can be enforced by way of an action for trademark infringement.
