Request For Admission at Legal Glossary What is it? A discovery procedure, authorized by the Federal Rules of Civil Procedure and the court rules of many states, in which one party asks an opposing party to admit that certain facts are true.

Request For Admission: Also, Request to Admit. Written statements of facts concerning a case which are submitted to an adverse party and which that party must admit or deny; a discovery device.

Request For Permission
"Courtroom procedure where one party requests that the opposition admits to certain facts' validity.

Request for Production: Part of the Discovery process. One attorney asks that the other side produce financial documents he or she feels are necessary to the case.
Residence: The place where a spouse lives.

Stipulations with request for award: A settlement in which the parties agree on the terms of an award. Payment takes place over time.

Request for Production - A formal court process by which one party requests that another produce certain documents or other tangible items.
Rescission - Cancellation of a contract.

REQUEST, pleading. The statement in the plaintiff's declaration that a demand or request has been made by the plaintiff from the defendant, to do some act which he was bound to perform, and for which the action is brought.

* Request for admission--a request to a party that he admit certain facts. One party sends the other a request for admission so that basic issues the parties agree upon can be resolved and not have to be proven if the parties go to trial.

Upon request, a bank must return to the drawer all the checks it has paid, so that the drawer can inspect the canceled checks to ensure that no forgeries or errors have occurred, in adjusting the balance of her or his checking account.

A written request to a higher court to modify or reverse the judgment of a trial court or intermediate level appellate court.

Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

MURDER
Intentional homicide (the taking of another person's life), without legal justification or provocation.

PRAYER A request for the relief sought in a Petition.
PRECEDENT A decision by another in another case with similar circumstances that is used as an example which resolves a similar question of law.

Appeal: A request for a case to be looked at again by a higher court. Permission is not always granted. Appeals are possible in civil cases from either the defendant or the claimant but in criminal cases only from the accused.

A request to change a decision or order. Usually an appeal will seek review of the decision by a different decision-maker.

Appeal: A request to the higher court for review of the lower court's decision and to request a reversal of the judgment.

APPEAL - A request to a supervisory court, usually composed of a panel of judges, to overturn the legal ruling of a lower court.
APPELLANT- The party who takes an appeal from one court to another.

APPEAL - A request to take a case to a higher court for review of proceedings in a lower court. No new evidence may be introduced during the appellate process; the reviewing court considers only whether errors occurred during prior proceedings.

The person who requests an action is brought by the Attorney General to enforce a public right. The Attorney General can refuse. The relator is not the claimant but he is liable for the costs of the proceedings.

Objection
A request to the court to determine that a line of questioning, procedure, or evidence is improper and should not be received by the court.

Modification: Request to change a prior order. Usually requires showing a change in circumstances since the date of the prior order.
Motion: Usually written request to the court in a case. Filed with the clerk's office.

Although procedures vary from one state to another, the request for a pardon usually involves a lengthy period of time of impeccable behavior and a reference check.

Formal discovery requests are not pleadings. Only the papers that state the essentials of the plaintiff’s or defendant’s case are pleadings.

Damages are a typical request made of a court when persons sue for breach of contract or tort.

Petitions set out the facts, identify the law under which the court is being asked to intervene, and end with a requested course of action for the court to consider (such as payment of damages).

MOTION FOR DIRECTED VERDICT: A request made by the defendant in a civil case. Asserts that the plaintiff has raised no genuine issue to be tried and asks the judge to rule in favor of the defense.

motion in limine - A written motion which is usually made before or after the beginning of a jury trial for a protective order against prejudicial questions and statements.

Interrogatories: A written set of questions sent from one party to the other during the discovery process.

Term: Letters Rogatory
Definition: A request from one court to another in a different state requesting that a witness in such other state be directed to submit to a deposition or answer written questions under oath.

presentence report - An investigation conducted at the request of the court after a person has been found guilty of a crime. The purpose is to provide the court with extensive background information to determine the appropriate sentence.

Contested Divorce An adversarial divorce proceeding in which the spouses cannot agree to a separation agreement.

Disclosure - Usually in the form of a request, this relates to the making available of relevant documents believed to be in the possession of the other party in inter partes proceedings.
