Substantive criminal law

Substantive Criminal Law: Law with the purpose of prevention of harm to society which prescribed punishment for specific offenses. The basic law of rights and duties as opposed to "remedial law" which provides methods of enforcement.

The Uniform Code of Military Justice (UCMJ) was enacted by Congress in 1950 (10 U.S.C.A. § 801 et seq.) to establish a standard set of procedural and substantive criminal laws for all the U.S. military services.

Substantive criminal law defines crimes, and procedural criminal law sets down criminal procedure. Substantive criminal law was originally common law for the most part. It was later codified and is now found in federal and state statutory law.
