Competent, Adult (Sui Juris) Parties: Both parties must have the capacity to understand the terms of the contract they are entering into, and the consequences of the promises they make.

Sui Juris Literally, "capable of answering lawfully in his own person", as opposed to one who is a minor or the ward of a guardianship incapable of being legally bound by his actions.

Some people are considered non sui juris: they do not possess full civil and social rights under the law. A child is non sui juris because the law seeks to protect the child from her improvidence until she reaches the age of majority.

As a general rule all persons sui juris may be either buyers or sellers. But to this rule there are several exceptions. 1. There is a class of persons who are incapable of purchasing except sub modo, as infants, and married women; and, 2.

It is not, therefore, requisite that a person be sui juris, or capable of acting in his own right, in order to be qualified to act for others.

Free. Not subject to restraint or control; having freedom of will; at liberty; also, that on which no charge is made. Compare with Frank. Liberated from control of a parent, guardian, or master; sui juris. Certain; honorable; becoming a freeman.
