Out loud; using the spoken word.
Evidence which is given orally to a Court by a witness' word of mouth (as opposed to in writing, such as by affidavit or deposition).

Viva voce. Latin. With living voice; by word of mouth; by spoken word; verbally; orally: as, testimony given viva voce in court; to vote viva voce.

VIVA VOCE. Living voice; verbally. It is said a witness delivers his evidence viva voce, when he does so in open court; the term is opposed to deposition.

Viva Voce Evidence Evidence that is given orally, as opposed to written evidence. Ex ParteLatin term, meaning made in the absence of the opposing party.

Consent is either express or implied. Express, when it is given viva voce or in writing; implied, when it is manifested by signs, actions or facts, or by inaction or silence which raise a presumption that the consent has been given.
